You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. 3. Products and Descriptions
Sweet House Gifts curates gift baskets containing products from various artisan and partner brands. We do not manufacture the individual products included in our gift baskets. Products sold on this site are manufactured and produced by third-party brands. We curate and resell these products but do not manufacture them.
We make every effort to display products accurately. However, colors, packaging, and arrangement may vary slightly from images shown. Product images are for illustration purposes only.
Gift basket contents may vary slightly from what is shown in product images. If a specific item becomes unavailable, we may substitute it with an item of equal or greater value and similar character. Substitutions are made at our discretion to ensure the overall quality and value of your gift basket is maintained.
4. Pricing and Payment
All prices are in United States Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors and to cancel orders resulting from such errors. Sales tax is calculated at checkout based on the shipping destination. Payment is taken when you place your order, including for baskets being restocked or available for pre-order, and is processed securely through a third-party payment processor.
5. Order Acceptance and Cancellation
All orders are subject to acceptance and availability. A confirmation email does not constitute acceptance of your order. We reserve the right to cancel orders for any reason, including inventory issues, suspected fraud, or pricing errors. If we cancel your order, you will receive a full refund.
You may request cancellation of your order before it has been processed for shipment. Once processing has begun, cancellation may not be possible.
6. Shipping and Delivery
Please refer to our Shipping Policy for information on shipping methods, estimated delivery times, and shipping rates. Risk of loss transfers to the carrier upon delivery to the carrier. We are not responsible for delays caused by the shipping carrier.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Sweet House Gifts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our maximum liability is limited to the purchase price of the specific order giving rise to the claim.
Products sold on this site are manufactured by third-party brands. We curate and resell these products but do not manufacture them. We are not liable for third-party product defects beyond applicable manufacturer warranties.
8. Indemnification
You agree to indemnify, defend, and hold harmless Sweet House Gifts, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your misuse of the Site, violation of these terms, or violation of any third-party rights.
9. Intellectual Property
All content on this Site, including text, graphics, logos, images, and software, is the property of Sweet House Gifts or its content suppliers and is protected by applicable intellectual property laws. Partner brand trademarks, names, and logos belong to their respective owners. No license is granted to reproduce, distribute, or create derivative works from Site content.
10. Governing Law and Disputes
These terms are governed by the laws of the State of New York, without regard to conflict of law provisions. Any disputes arising from these terms or your use of the Site shall be resolved in the state or federal courts located in New York County, New York.
11. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between you and Sweet House Gifts regarding your use of the Site.
